Q: What types of applications can I analyze using PatentTerm Online?

A: PatentTerm Online can assist with AIPA patent term adjustment calculations for the following application types: (1) U.S. National Applications under 35 USC § 111(a); (2) U.S. National Stage of PCT Applications designating the U.S. under 35 U.S.C. § 371; and (3) Converted Provisional Applications under 35 USC § 111(b).
PatentTerm Online can analyze both published and unpublished applications.

Q: Can I use PatentTerm Online to analyze design applications?

A: No. Design applications have a fixed term and are not subject to Patent Term Adjustment under AIPA.

Q: Can PatentTerm Online analyze unpublished applications?

A: Yes, PatentTerm Online can analyze both published and unpublished applications. For unpublished applications, however, the user must have access to the application in the private PAIR system to input prosecution history.
